Franchisee Attorneys Often Complain Franchisors Scam Franchise Buyers
So often franchise attorneys complain that franchise buyers get the shaft from fast-talking franchisors and complex franchise agreements, which make it nearly impossible for the franchisee to get a fair shake. I have heard this complaint time and time again as a Board of Director Member of the American Association of Franchisees and Dealers, as franchise attorneys looked for an easier way to sue franchisors on behalf of their franchisee clientele.
Once a franchise attorney looked over my franchise agreement for his franchisee client buyer and wanted me to change a bunch of stuff otherwise he would advise his franchisee buying client to walk? “Fine” I told him; “Take a Hike!” And then after the deal was dead, I emailed him and stated;
“Thanks for your advise on my franchise agreement and UFOC, but don’t bother billing me for such worthless advise. Look in the mirror and ask yourself, are you the problem with today’s franchising industry? Isn’t it really all this legal garbage that is to blame in the first place?”
I talked with Mr. Rosenburg, founder of Duncan Donuts about attorneys and franchising once and he just threw up his hands and laughed and said it is a much different world now. That came from one of the greats in franchising. I’d like to hear what Tom Monahan, and Dave Thomas think about franchise attorneys and all this legal stuff. I bet they aren’t fond of the system either. Consider all this in 2006.
